Distance Sales Agreement

This Distance Sales Agreement ("Agreement") is drawn up in accordance with the Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts. By approving your order on our platform, you acknowledge that you have read, understood, and agreed to be bound by these terms.

2. Subject of the Agreement

This Agreement regulates the rights and obligations of the Parties regarding the sale and delivery of the product(s) or service(s) ordered electronically by the Buyer via the Seller’s website, in accordance with the relevant Turkish consumer protection laws.

4. General Provisions & Delivery

  • Information Accuracy: You confirm that all personal, billing, and delivery information provided is accurate. The Seller is not liable for delays or issues caused by incorrect information.

  • Delivery Timeframe: We will deliver your order within the timeframe promised during checkout, and in any case, no later than the legal maximum of 30 days. If we fail to deliver within this period, you have the right to terminate the contract.

  • Unavailable Products: If the ordered product becomes impossible to supply, we will notify you within 3 days and refund the total amount to your original payment method within 14 days.

  • Force Majeure: If unforeseen circumstances (e.g., extreme weather, infrastructure failures) prevent delivery, we will notify you. You may choose to cancel the order for a full refund or wait until the situation is resolved.

  • Inspection on Delivery: Please inspect your package upon delivery. Do not accept damaged or tampered packages from the courier. Accepting the package means you verify it was delivered in good condition.

5. Right of Withdrawal (Returns)

You have the right to withdraw from this contract within 14 days without giving any reason and without paying any penalty, starting from the day you (or your designated recipient) receive the goods.

  • How to Exercise: Notify us via email (info@buneyemek.com) or in writing within the 14-day period.

  • Return Conditions: The product must be returned unused, undamaged, and complete with its original box, packaging, standard accessories, and the original invoice.

  • Refunds: Once we receive your valid withdrawal notice and the returned goods, we will refund your total payment (including standard delivery costs) within 14 days.

6. Non-Returnable Items

For health, hygiene, and legal reasons, the Right of Withdrawal cannot be exercised for the following items (unless they are defective):

  • Products prepared in line with the Buyer's explicit personal requests or custom needs.

  • Perishable goods or goods with a short expiration date (e.g., fresh food).

  • Products whose protective packaging (seals, bands, shrink wrap) has been opened after delivery (e.g., cosmetics, personal care items, underwear, swimwear).

  • Digital content, software, and audio/video recordings if the seal has been broken.

  • Services that have already begun execution with the consumer's consent before the withdrawal period ends.

7. Payment Defaults & Legal Consequences

If you default on a credit card transaction, you will be liable to pay interest and any associated fees as per your independent agreement with your bank. The bank may take legal action, and you will be responsible for any resulting legal costs and attorney fees. Furthermore, you agree to compensate the Seller for any loss or damage resulting from the delayed fulfillment of your debt.

8. Dispute Resolution & Jurisdiction

In the event of a dispute arising from this Agreement, Turkish law shall apply. You may submit your complaints and objections to the relevant authorities based on the monetary limits updated annually by the Turkish Ministry of Trade:

  • Consumer Arbitration Committees (Tüketici Hakem Heyetleri) in your district or province for disputes under the annually announced monetary threshold.

  • Consumer Courts (Tüketici Mahkemeleri) for disputes exceeding the monetary threshold.

9. Effectiveness

By checking the "I have read and agree to the Distance Sales Agreement" box at checkout and completing your payment, you electronically sign and accept all terms within this Agreement.
